1.1. These Terms and Conditions govern the participation in and use of Utopia’s Tire Storage Program (the "Program").
1.2. By enrolling in the Program and making payment, the Customer ("You" or "Customer") agrees to these TERMS AND CONDITIONS.
2.1. To participate in the Program, Customers must register and provide accurate and complete information. The Program is open to individuals who are at least 18 years old.
2.2. Modern electronic signatures and generally accepted authentication protocol shall be considered adequate signatures. All payments made over the phone and delivery of tires by Customer to Utopia indicate acceptance of all terms and conditions in lieu of signatures.
3.1. The storage fee (referenced section 13) will be determined at the time of registration and is subject to change with prior notice. Payment for storage must be made in full at the time of tire drop-off or at the time the tires to be stored are removed from the vehicle.
3.2. Failure to pay storage fees may result in the termination of storage services and disposal of tires as per Section 6.
3.3. Utopia will not prorate or refund parts of a month where storage does not occur. Billing is not pro-rated on a daily or monthly basis. Terminated services may be refunded after rounding up to the next full month + $15 early termination fee.
3.4. Utopia may charge a $10 per tire cleaning fee for tires covered with mud or tires with solvents inside.
3.5. By signing the credit card release form on Exhibit B, customer gives Utopia permission to charge customer’s credit card every 6 months.
4.1. Tires may be stored for a maximum period of one ‘season.’ The winter season typically begins September to November and lasts 6-9 months; the summer season typically begins April to June and lasts 5-7 months. Customer may write to Utopia requesting an extension for storage for an additional seasonal charge.
4.2. If the Customer does not retrieve the tires within the agreed storage period, Utopia may, at its discretion, charge additional storage fees or dispose of the tires as per Section 6, unless Customer has made other arrangements with Utopia which shall be in writing (email, text message, etc.)
4.3. The Customer will allow Utopia a minimum of two business days to retrieve tires after successfully and adequately submitting a request. Utopia shall not be obligated to deliver within its stated schedule when events beyond its control occur, such as snow, ice, road closures, traffic jams, or extreme weather. When such conditions end, Utopia shall reasonably resume its obligations.
4.4. If the Customer misses their SWAP appointment without notification, and this causes tires to be retrieved and then re-stored, Utopia may charge Customer $15.00 for additional retrieval services. If Customer misses additional follow-up appointments and Utopia must return tires to storage, an additional fee of $20 may be charged.
4.5. Tire delivery constitutes conclusion of Utopia's responsibility. Subsequent storage indicates the continuation of the agreement under the current Terms of Service. Failure to pay within seven business days (non-holiday or weekend) shall result in a late fee per Service Charges and Fees Table (Section 13).
5.1. The Customer is responsible for ensuring tires provided for storage are clean and in suitable condition.
5.2. The Customer must inform Utopia of any changes to Customer’s contact information during the storage period (name, phone number, email address, etc.).
5.3. The Customer agrees to confirm that the labels for the tires to be stored are clearly marked and correct.
5.4. The Customer agrees to pay all outstanding service charges and fees within seven business days (non-holiday or weekend) of their bill date, and to have all amounts owed paid in full before requesting availability of their tires.
6.1. If the Customer fails to retrieve stored tires within 30 days after the end of the storage period, and Customer has not paid for the next tire storage season, or after being notified by Utopia of such failure to pay, the tires will be considered abandoned.
6.2. Utopia reserves the right to dispose of abandoned tires without further notice and without liability to the Customer. Any costs associated with the disposal of abandoned tires will be the responsibility of the Customer.
7.1. Utopia will take reasonable care to ensure that the tires are stored safely; however, Utopia is not liable for any damage to or loss of tires due to circumstances beyond its control, including but not limited to fire, theft, or natural disasters.
7.2. If Utopia damages or loses the Customer’s tires, Utopia will repair or replace with comparable property equal to or higher than the value of the Customer’s tires at the time of the loss at Utopia’s sole discretion and expense. Utopia is not responsible for any damage or blemishes to wheels or tires where indicated on Exhibit A.
8.1. Utopia reserves the right to terminate the storage agreement at any time with prior notice.
8.2. Upon termination, the Customer must retrieve their tires within seven business days. If not retrieved, the tires will be disposed of as per Section 6.
9.1. Utopia reserves the right to modify these Terms and Conditions at any time. Any changes will be communicated to the Customer and will take effect immediately upon notification.
9.2. Neither party may assign or delegate unless the other party gives written consent, which shall not be unreasonably withheld.
10.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of Colorado and Summit County.
10.2. Before litigating any dispute arising out of this agreement, Customer agrees to mediate and/or arbitrate disputes through a dispute resolution program. By agreeing to submit any dispute arising out of this agreement, Customer agrees that no dispute shall be submitted to arbitration before exhausting informal grievance procedures.
11.1. If any part of this agreement is invalidated, the rest of the agreement shall remain valid and unchanged.
